IN THE PROPOSED VERSION
OF THE LAW FOR DONATIONS AND SPONZORSHIP
CORRECTIONS HAVE TO BE MADE

In this law it is said that “tax release will be given to the donor who is giving only 24.000 MKD, no matter for the total amount of donation”. This will not stimulate potential donators. “It is logically that the donation should have tax release that will decrease or change depends on the amount of money given as donation - more money more tax release”, said the representatives of NGO sector in yesterday press conference concerning the new proposed law for donations and sponsorship in public sector.

- We are in the period before adoption of this law which has extraordinary meaning for civil sector in Macedonia. During last several years in Macedonia there was a tendency of decreasing the foreign donations and funds for the civil initiatives, so adoption of this law would mean that civil sector and civil initiatives will be revived. In order this law to function in the best possible way it is necessary to make slight changes in order the final version of the law to be better – said Ms. Biljana Peseva from NGO “SUNA Association “

NGO sector believe that the government should form special commission that will decide which organizations could realize various projects of public interest. Non governmental organizations also believe that by this way the government will increase the control in civil initiatives.

- It is better to establish separate NGO body that will define which organizations could implement civil initiatives of public interest. This would be a better solution (NGO body instead of government body).

At this moment, the last version of this law is not enough elaborated and this may create future problems. It is necessary this version to be improved before the law enters the parliament. – said Mr. Professor Dr Jordan Jakimovski from the Institute for Sociological and Juridical Research.

On behalf of Mr. Jakimovski, the things as they are now in existing version of the law will make confusion especially in the part concerning the obligations for the donors. In the proposed version of the law donor will not be punished for eventually problems for misuse the donation but all the responsibilities will have only the receiver of the donation.

- It should be explained the exact obligations of the donator (same as it was explained for the receiver of donation) and punishments for un-conscious working should be executed on both – said Mr. Jakimovski
